What does Florida Telephone Solicitation Act (FTSA) mean for texting and calling customers?

Florida’s FTSA, in force since 1 July 2021 and amended on 25 May 2023, requires prior express written consent for sales calls and texts made with automated systems for selecting and dialing numbers. Sales calls are limited to 8 a.m.–8 p.m., no more than three calls on the same subject in 24 hours, and consumers can sue for $500 to $1,500 per violation. Under the 2023 amendment, a consumer must first reply STOP and give the business 15 days to stop before suing over unwanted texts. Florida also keeps its own state Do Not Call list.

The federal TCPA still applies on top, along with A2P 10DLC registration for business texting numbers. In practice, a Florida business that only texts people who opted in, inside the state’s hours, and stops instantly on STOP, is on solid ground. That is the setup we build.

The setup

How is GoHighLevel set up for a Florida business?

Florida requirement What we configure in GoHighLevel Why it matters
Consent before marketing texts An unticked SMS consent box on every form and chat widget, with the consent wording saved on the contact record and a consent tag that every marketing workflow checks first Required under Florida Telephone Solicitation Act (FTSA) and the federal TCPA
Sending hours Workflow wait windows set to 8 a.m.–8 p.m., in each contact’s own time zone A text that lands outside the window is a compliance risk and an annoyed customer
Time zones Most of Florida runs on Eastern Time; the western Panhandle, west of the Apalachicola River, runs on Central Time. Each contact’s time zone is set from the address. Reminders and follow-ups arrive at the hour the customer expects
Do Not Call lists DND flag on numbers found on the national registry or the Florida state list before any cold outreach Opted-in leads are fine to follow up; cold lists are not
STOP and opt-out Automatic DND on STOP, UNSUBSCRIBE and similar replies, across SMS and WhatsApp Carriers and the TCPA require it
A2P 10DLC Brand and campaign registration with use-case wording that matches the consent text US carriers filter unregistered business texts
Local demand

What makes Florida different for a service business?

  • Hurricane season, June to November, drives roofing, restoration, generator and HVAC demand.
  • Winter residents arrive from roughly November to April and fill clinic, med spa and home-service calendars.

In each case the business that answers first usually books the job. An AI receptionist on a local number, missed-call text back and same-minute replies to form and ad leads are the first three workflows we switch on for Florida clients.

Common questions from Florida business owners

Can I be sued for sending marketing texts in Florida?

Yes. The FTSA lets consumers sue for $500 to $1,500 per violation, but since 2023 they must first reply STOP and give the business 15 days to stop. Written consent and instant STOP handling in GoHighLevel are the protection.

What hours can I text customers in Florida?

Under Florida Telephone Solicitation Act (FTSA), sales contact is limited to 8 a.m.–8 p.m.. We set GoHighLevel workflows to wait for that window in each customer’s own time zone.

Does Florida have its own Do Not Call list?

Yes. Florida keeps a state Do Not Call list separate from the National Do Not Call Registry, so cold outreach is checked against both.

Which time zone do Florida workflows use?

Most of Florida runs on Eastern Time; the western Panhandle, west of the Apalachicola River, runs on Central Time. We set each contact’s time zone from their address so reminders arrive at the right local hour.

Do you work with businesses in Miami-Dade?

Yes. We work remotely with businesses anywhere in Florida, including Miami-Dade, Broward, Palm Beach and Hillsborough, using local phone numbers in your area code.

How long until we go live?

Mostly it depends on A2P 10DLC approval for your texting number, which carriers review separately. We file it on day one so the rest of the build is ready when it clears.
